Petition filed under Section 438 Cr.P.C.

Petitioner is alleged to have committed the offences under Sections 143, 147, 353, 332 read with Section 149 of Indian Penal Code.

There was an agitation against laying of pipe line for a project of the GAIL Limited. It is alleged that in the course of agitation the petitioner along with the coaccused assaulted two police constables. 4.
Heard.

The injuries sustained by the police constables are not of serious nature. Custodial interrogation of the petitioner is not necessary for effective investigation. In the result, this application is allowed.

The petitioner shall be released on bail after interrogation on his executing a bond for Rs.25,000/- (Rupees Twenty five thousand only) with two solvent sureties each for the like sum if he is arrested by the police in connection with this case.

He shall appear before the investigating officer for interrogation between 10 a.m and 11 a.m every Wednesday for two months 3.
He shall not get himself involved in any other criminal case while he is on bail.

He shall not intimidate or attempt to influence the witnesses.

He shall not destroy or tamper with evidence. In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with law.
If the petitioner surrenders before the Magistrate this order is not applicable and the learned Magistrate may pass appropriate orders.
