Petitioner is involved in Crime Nos.737/CR/EOW-I/KLM and 738/CR/EOW-I/KLM of CBCID, HQ, Thiruvananthapuram registered for offences punishable under Sections 409 and 477A read with Section 34 of the Indian Penal Code.

Common allegations in both the cases are that the petitioner along with other accused persons committed misappropriation of certain amounts from Kulanada Service Co-operative Bank and thereby he has committed the above said offences.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

It is submitted that at present there are four crimes against the petitioner and out of which, he is on pre-arrest bail in two cases. Considering the nature of allegations, I do not find any necessity to have a custodial interrogation. Hence the following order: i.
Petitioner shall surrender before the investigating officer
BA No.3694 & 3695/2015 within a period of two weeks and submit himself for interrogation. Thereafter he, in each case, shall execute a bond for `25,000/- (Rupees twentyfive thousand only) with two solvent sureties each for the like sum to the satisfaction of the investigating officer. In that event, he shall be released on bail in Crime Nos.737/CR/EOW-I/KLM and 738/CR/EOWI/KLM of CBCID, HQ, Thiruvananthapuram. ii.
The sureties shall produce documents to establish their identity and solvency.
iii.
Petitioner shall appear before the Investigating Officer as and when directed in writing and co-operate with the investigation in the matter.
iv.
He shall not influence or intimidate the witnesses. In case of violation of any of the above conditions, the officer concerned is free to arrest the petitioner as if no order is passed. A. HARIPRASAD, JUDGE.
