Petition filed under Section 438 Cr.P.C.

Petitioners are alleged to have committed the offences under Sections 341, 323, 324, 452, 506(ii), 294 (b), 354 read with Section 334 of the Indian Penal Code. 3.
The prosecution case is that they trespassed into the house of the victim, wrongfully restrained him, threatened him and assaulted him with an iron rod. Further, they outraged the modesty of the victim's mother. 4.
Heard.

It is seen that before the incident alleged in this case took place the victim had allegedly outraged the modesty of the cousin of the petitioners at a public place, for which the police have registered a case against him. The victim in this case sustained only minor injuries. It appears that custodial interrogation of the petitioners is not necessary for effective investigation.
In the result, this application is allowed.

The petitioners shall be released on bail after
B.A. No.3713 of 2015 interrogation on their executing a bond for Rs.25,000/- (Rupees Twenty five thousand only) each with two solvent sureties for the like sum each if they are arrested by the police in connection with this case.

They shall appear before the investigating officer for interrogation if they are so required by him in writing. 3.
They shall not get themselves involved in any other criminal case while they are on bail.
4.
They shall not intimidate or attempt to influence the witnesses.
5.
They shall not destroy or tamper with evidence. In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with law.
If the petitioners surrender before the Magistrate this order is not applicable and the learned magistrate may pass appropriate orders.
