Petition filed under Section 439 Cr.P.C.
2.
Petitioner is accused of having committed the offence under Sections 452 and 307 of Indian Penal Code. 3.
He is the husband of the victim. The prosecution case is that at 8.30 in the night on 15.06.2015 he trespassed into the house in which the victim was residing and stabbed her with a knife. The enmity was due to the fact that she filed one case against the petitioner. There is another case against her filed by him. The wound certificate proves that she sustained injuries in her abdomen, on the right thigh and the right palm. Prima facie, the petitioner has committed the offences alleged against him. He has been in custody since 15.06.2015. But it appears that if he is released on bail there is every likelihood of his influencing or intimidating the witnesses. So it is not proper to grant him bail.
B.A. No.3786 of 2015 In the result, this application is dismissed. sd/- K. ABRAHAM MATHEW JUDGE R.AV //True Copy// PA to Judge
