Petition filed under Section 439 Cr.P.C.

Petitioner is said to have committed the offences under Sections 143, 147, 148, 447, 427, 307 read with Section 149 of Indian Penal Code and Section 3 and 5 of the Explosive Substance Act.

The prosecution case is that he along with the co-accused due to political enmity formed themselves in an unlawful assembly and attempted to murder the victim by hurling a bomb at his house. In the incident the victim sustained a loss of Rs.10,000/- (Rupees ten thousand only).

The incident happened at 1 in the night. The petitioner is said to have been identified by the light of a motor cycle. He has been in custody since 15.06.2015. His further detention is not necessary for completion of the investigation.
In the result, this application is allowed.

The petitioner will be released on bail on his executing a bond for Rs.50,000/- (Rupees Fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate concerned. 2.
He shall appear before the investigating officer between 10.30 a.m and 11.30 a.m on every Thursday for four months, or till the final report is filed, whichever is earlier.

He shall not threaten or attempt to influence the witnesses, nor shall he while on bail, get himself involved in any criminal case; nor shall he destroy or attempt to destroy the evidence or interfere with the investigation. 4.
He shall not enter the territorial jurisdiction of Peringome police station till the conclusion of the investigation.
If the petitioner violates any of the above conditions, the court of enquiry/trial is empowered to cancel the bail in accordance with the law.
