O R D E R

Petition filed under Section 438 Cr.P.C.

2. Petitioner is accused in Crime No.674 of 2015 of Kottayam West Police station registered for the offences under Secs.408 and 420 read with Sec.34 of the Indian Penal Code. He was entrusted with the cash required to be filled up in an ATM counter of a bank. The allegation is that he misappropriated about Rs.75 lakhs.

3. Heard both sides.

4. It is not in dispute that the bank entrusted the amount to the petitioner. According to the prosecution, he misappropriated about Rs.75 lakhs and gave it to the 1st accused.

5. The submission of the learned counsel that the petitioner had only a little experience and he did not commit the offence cannot be accepted as true at this stage. There is a prima facie case against the petitioner. It is not proper to grant him anticipatory bail.
