Petition filed under Section 438 Cr.P.C.
Petitioner is accused of having committed the offences under Sections 3, 4, 5,7 & 8 of the Immoral Traffic Prevention Act, 1956. The prosecution case is that in a raid conducted by the Police Officer concerned, it was noticed that in the six rooms in the tourist home the Manager of which was the petitioner, immoral activities were being conducted.

Learned counsel submits that the petitioner was not aware of the immoral activities occurred in the rooms. The circumstances and facts of the case incline me to believe that without his knowledge and consent, the immoral activities could not have happened. This is not a fit case to grant anticipatory bail.
