Petitioner is the accused in Crime No.740 of 2015 of Pandalam Police Station registered for the offences under Sections 294(b) and 326 and later added Sections 465,468,471 and 420 of IPC.

The prosecution case is that he along with his co-accused, who is none other than his brother uttered obscene words and assaulted the victim with a piece of granite. The motorcycle on which he came to the place of occurrence had a false registration number. The documents relating to the vehicle were false documents.

Learned counsel submits that the petitioner is a mechanic in an automobile workshop owned by one Vijayan and the motorcycle was the one entrusted to Vijayan by a person belonging to Punjab. This cannot be accepted easily. The petitioner is not aware of the particulars of the person who allegedly entrusted the vehicle. The offences he is said to have committed are of a serious nature. If he is released on bail at this stage, there is every likelihood of his influencing or intimidating the witnesses. So it is not in public interest to grant him bail at this stage.
