Petition filed under Sec.438 Cr.P.C.

2. Petitioner is accused in Crime No.601 of 2015 of Palode Police station registered for the offences under Secs.294(b), 307, 323 and 341 of the Indian Penal Code. The prosecution case is that he stabbed the victim with a knife causing him serious injuries.

3. Heard both sides.

4. The wound certificate of the victim shows that he sustained serious injury on his neck apart from other injuries. It is an admitted fact that the injuries were caused with a knife. The petitioner's case is that when the victim attempted to stab him with a knife, he wrested the knife from him and in private defence assaulted him. As of now, there is nothing to indicate that the defence version is probable. The attack was on the vital parts of the body. The injuries were serious. Recovery of the

B.A. No.3925 of 2015 2 weapon has not been effected. So it is not proper to grant him anticipatory bail.
