Petition filed under Sec.439 Cr.P.C.

2. Petitioner is accused in Crime No.522 of 2015 of Njarakkal Police station registered for the offences under Secs.363 and 376 of the Indian Penal Code and Sec.5(1) of the Protection of Children from Sexual Offences Act, 2012. The prosecution case is that he kidnapped a girl aged 14 years and committed rape on her.

3. Heard both sides.

4. The victim was aged only 14 years. The submission of the learned counsel that the petitioner was in love with the girl is not at all a ground to take a lenient view. If the petitioner is released on bail there is every chance of his influencing or intimidating the girl. So I am not inclined to grant him bail now though he has been in custody since 06.06.2015.
