ORDER

Petition under Section 438 of the Code of Criminal Procedure. 2.

Petitioners are accused 3 and 4 in Crime No.752 of 2015 of Mannuthy Police Station registered under Sections 420, 379, 468, 471, 406 and 409 read with Section 34 of the Indian Penal Code. Prosecution case, in brief, is that the petitioners are office staff of SNDP Yogam, Mannuthy Union. Yogam conducted micro finance and misappropriated huge amounts, approximately `1,27,00,000/- causing loss to the depositors. 3.

Heard both sides.

Learned counsel for the petitioners submitted that they are only employees and have no connection with the crime. Learned Prosecutor submitted that the petitioners are also to be questioned for the purpose of investigation. It is also brought to my notice that other accused in the same crime have been released on pre-arrest bail as per order dated 04.09.2015 in B.A.Nos.3164 of 2015 and 4061 of 2015. Considering the nature of allegations, following directions are issued:

i.

Petitioners shall appear before the investigating officer

BA No.3944/2015 within a period of two weeks and submit themselves for interrogation. Thereafter each one of them shall execute a bond for `25,000/- (Rupees twentyfive thousand only) with two solvent sureties each for the like sum to the satisfaction of the investigating officer. In that event, they shall be released on bail in Crime No.752 of 2015 of Mannuthy Police Station. ii.

The sureties shall produce documents to establish their identity and solvency.

iii.

Petitioners shall appear before the Investigating Officer as and when directed for the purpose of investigation in the matter. iv.

They shall not influence or intimidate the witnesses. In case of violation of any of the above conditions, the learned Magistrate having jurisdiction is empowered to cancel the bail in accordance with law without referring the matter to this Court. A. HARIPRASAD, JUDGE.
