Petition filed under Sec.439 Cr.P.C.

2. Petitioner is the 2nd accused in C.R. No.19 of 2015 of Kolazhi Excise Range registered for the offences under Secs.55(a) and 58 of the Kerala Abkari Act. The prosecution case is that he was found transporting 1085 litres of spirit.

3. Heard both sides.

4. Learned counsel submits that taking into consideration the period of custody, the petitioner may be granted bail.

5. The petitioner has been in custody since 23.05.2015. The quantity of illicit liquor seized from him is very huge. The facts do not justify granting him bail now as the investigation is only in progress. In the result, the bail application is dismissed. Sd/- K. ABRAHAM MATHEW JUDGE NS
