Petitioner is the first accused in Crime No.546 of 2014 of Sasthamcotta police station registered for the offences under Sections 147, 148, 294(b), 506(ii), 323, 324, 308 & 34 of the Indian Penal Code.

The prosecution case is that he along with the co-accused assaulted the victim with dangerous weapons causing him very serious injuries.

The petitioner and the co-accused had filed Bail Application No.3534 of 2014 for anticipatory bail. This court rejected the prayer of the petitioners and allowed the prayer of the others. This second application is filed on the ground that the investigation is over. The learned Public Prosecutor submits that the submission is wrong. On a mere allegation that the investigation is over the second bail application cannot be entertained.
