O R D E R

Petitioner seeks pre-arrest bail under Section 438 Cr.P.C in a case where he absconded from the trial court. Non bailable warrant is pending against him in this case. He is involved in an offence punishable under Section 138 of the Negotiable Instruments Act.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

Learned counsel for the petitioner submitted that in pursuit of a job he went abroad. So he could not appear before the court. Considering the nature of allegations and the facts presented, I am of the view of that following directions can be passed :

Petitioner shall surrender before the Judicial First Class Magistrate Court - I, Haripad within a period of one month from

B.A No.4047 of 2015 2 today and seek bail in the above case. In that event, the learned Magistrate shall consider the application as expeditiously as possible on merits, if possible on the date of surrender itself.

The application is disposed of.
