Petition filed under Section 439 Cr.P.C.

Petitioner is accused of having committed the offences under Sections 143, 144, 147, 148, 447, 342, 324, 326, 302, 118, 150, 151, 120B, 212 IPC and Sections 20 read with Section 27 of the Arms Act. The prosecution case is that one of the co-accused hired the petitioner and others for committing murder of the victim and accordingly, the petitioner and the co-accused committed murder of the victim.

It is submitted that the petitioner has been in custody since 04.02.2015 and he may be granted bail. Final report has already been filed. The case has been taken on the file of Judicial First Class Magistrate, Alappuzha as C.P. No. 41 of 2015. The petitioner is involved in two other criminal cases. Having regard to the nature of the offences and the allegations against him, it is not at all proper to release him on bail at this stage. In the result, this application is dismissed. Sd/- K.
