Petition filed under Section 438 Cr.P.C.
2.
Petitioner is alleged to have committed the offences under Sections 409, 419, 420, 468 read with Section 34 IPC. The allegation is that he along with the co-accused made a false promise that they would get a visa for the victim and received from him Rs.2,00,000/- and failed to get a visa for him. 3.
Heard.
4.
The specific case of the first informant is that the petitioner and the co-accused made a promise that they would get a visa for him and they received Rs.2,00,000/-. The averments in the complaint show that the first informant handed over the amount to the first accused, who handed it over to the petitioner and another co-accused. The petitioner has no case that he or the co-accused were able to obtain a visa for the first informant. The involvement of the petitioner is clear from the averments in the complaint. This is not a fit case to grant

anticipatory bail.
In the result, this application is dismissed. Learned counsel submits that the petitioner will surrender before the Investigating Officer. He may do so if he is so advised.
