Petitioner is alleged to have committed the offence under Sections 20 and 21 of the Kerala Protection of River Banks and Regulation of Removal of Sand Act, 2001. The prosecution case is that he was found transporting river sand without any permit or other authority.

When the police noticed the petitioner transporting river sand in a goods carriage, he just ran away. He has no case that he had a permit to transport river sand. It is a serious offence. This is not a fit case to grant anticipatory bail. In the result, this application is dismissed. Learned counsel submits that the petitioner will surrender before the Investigating Officer. Hey may do so if he is so advised.
