O R D E R

Petition filed under Sec.438 Cr.P.C.

2. Petitioner was an accused in O.R. No.1 of 2004 of NCB/RIU/Thiruvananthapuram/L.P.No.44/15 of Additional Sessions Court-V, Thiruvanthapuram. Since he was absconding, the case against his co-accused was tried and the case against him was split up by the Trial Court. The case of the petitioner was removed to the register for long pending cases. Later, he surrendered before the Trial Court. The number of the present proceedings is not given in the bail application. He has been in custody for 105 days. He prays that he may be released on bail.

3. Heard.

4. The petitioner absconded for a very long period. Now he is in custody. I am not satisfied that if he is released on bail, he will not abscond again. In the result, this bail application is dismissed.

B.A. No.4105 of 2015 2 The Trial Court will make all earnest efforts to dispose of the case without delay.
