Petition filed under Sec.439 Cr.P.C.
2. Petitioner is accused in Crime No.71 of 2015 of Karunagappally Excise Range registered for the offences under Secs.55(a) and (i) of the Kerala Abkari Act. The prosecution case is that she was found selling Indian Made Foreign Liquor. 12.5 litres of liquor was seized from her house.
3. Heard both sides.
4. Learned counsel submits that the petitioner has been in custody since 03.6.2015 and she may be granted bail.
5. The application is opposed by the learned Public Prosecutor who submits that the petitioner is involved in ten other cases registered under the Kerala Abkari Act.
6. There are no grounds to believe that she has not committed the offences alleged against her or that
B.A. No.4109 of 2015 2 she will not commit it again if she is released on bail. Merely because she has been in custody since 03.06.2015, she cannot be released on bail.
