Petition filed under Sec.438 Cr.P.C.
2. Petitioners are accused in Crime No.831 of 2015 of Vadakkanchery Police station registered for the offences under Secs.143, 147, 148, 427 and 452 read with Sec.149 of the Indian Penal Code. The prosecution case is that armed with deadly weapons like iron rod, pieces of bamboo and pieces of granite they trespassed into the house of the victim, threatened her and committed mischief by destroying the household articles causing a loss of Rs.60,000/-.
3. Heard both sides.
4. Learned counsel submits that no one sustained injury in the incident and the allegations are false.
5. Whether anybody sustained injuries or not is irrelevant in the nature of the case. It is outrageous to trespass into a woman's house armed with deadly
B.A. No.4115 of 2015 2 weapons. It is said that it was in search of the victim's son, the petitioners trespassed into her house.
6. Having regard to the facts of the case, I do not think it proper to grant anticipatory bail to the petitioners.
