ORDER

Petition filed under Section 438 Cr.P.C.

2. Petitioner is the accused in Crime No.485 of 2015 of Vazhakkad Police Station, Malappuram District. He is alleged to have committed the offences under Section 379 IPC and Section 12 read with Section 20 and 23 of the Kerala Protection of River Banks and Regulation of Removal of Sand Act.

3. The prosecution case is that he was found transporting river sand in a lorry without any permit.

4. Heard.

5. The petitioner was the owner-cum-driver of the vehicle involved in the incident. There is a prima facie case against him.

6. Having regard to the nature of the offences, it is not proper to grant him anticipatory bail.
