Petition filed under Section 439 Cr.P.C.

Petitioners are alleged to have committed the offences under Sections 55(a)(i) and 55(D) read with Section 67(B) of Kerala Abkari Act. The prosecution case is that they were found transporting of 50 litres of Indian Made Foreign Liquor without any licence and it was meant for sale.

Heard.

Petitioners were caught red handed. The quantity of the liquor seized indicates the purpose for which it was being transported.

Learned counsel submits that the petitioners are only about 23 years old. That does not mitigate the seriousness of the offence committed by them.
