ORDER

Petition filed under Section 439(1) Cr.P.C.

2. Petitioner is the 12th accused in Crime No.1906 of 2015 of Kayamkulam Police Station. He along with co-accused is alleged to have committed the offences under Sections 120(B), 115, 143, 147, 148, 341, 324, 326 and 307 read with 149 IPC and Section 5(a) read with 27(1) of Arms Act.

3. The prosecution case is that the accused entered into the conspiracy to do away with the victim and pursuant to it armed with deadly weapons like sword they assaulted the victim causing him very serious injuries.

4. Heard.

5. Learned counsel submits that the petitioner did not take part in the incident and he has been in custody since 4.7.2015 and he may be granted bail. The case diary reveals that the petitioner informed the other accused about the movements of the victim so that they might attack him.
