Petition filed under Section 438 Cr.P.C.

The petitioner apprehends that he will be arrested by the police on the allegation that he has committed the offence under Section 304 of the Indian Penal Code, 1860. The case was registered for the offence under Section 304 IPC. 3.

Learned Public Prosecutor submits that the investigation has revealed that only 304A IPC is attracted. A report has already been filed by the Investigating Officer to that effect in the Magistrate court concerned. The offence under Section 304A IPC is bailable.
