Petition filed under Section 438 Cr.P.C.

2.

Petitioner is the accused in OR/4/2014 registered by Peechi Forest Range for the offences under various provisions of Wildlife Protection Act. 3.

The allegation is that he trespassed into the reserve forest and killed a bison.

4.

Heard.

5.

The petitioner had filed Bail Application No.8045 of 2014 for the very same purpose which was dismissed by this court by Annexure-2 order. The subsequent development pleaded is that his father was under treatment from 20.06.2014 till 14.03.2015, on which day he died. That is not a subsequent development. The learned counsel further submits that though the earlier bail application was dismissed there was a direction to him to surrender before the investigating officer within seven days from the date of the order and he could not comply with it

B.A. No.4283 of 2015 because of the illness of his father. Whatever may be the reason for his non compliance with the direction it is not a ground to maintain the second bail application. I do not find any merit in this application.

In the result, this application is dismissed. sd/- K. ABRAHAM MATHEW JUDGE R.AV //True Copy// PA to Judge
