Petitioner is said to have committed the offences under Section 379 of the Indian Penal Code and Sections 20 and 21 of the Kerala Protection of River Banks and Regulation of Removal of Sand Act, 2001. The prosecution case is that he being the owner of a vehicle, was found transporting river sand in it without any permit.
