Petitioner is alleged to have committed the offences under Sections 420 read with Section 34 of the Indian penal Code and Sections 4, 5 & 6 of the Prize Chits and Money Circulation Schemes (Banning) Act.

The prosecution case is that he along with the co-accused collected huge amount from several persons and cheated them by not repaying the amount.

The learned Public Prosecutor submits that the petitioner has been issued notice under Section 41A Cr.P.C and if there is no strong evidence against him he will not be arrested. In view of the submission his prayer need not be granted.

In the result, these applications are dismissed. Submission of the learned Public Prosecutor that the

B.A. No.4303 of 2015 and 4309 of 2015 petitioner will not be arrested on his appearance pursuant to the notice issued to him is recorded.
