Petition filed under Section 439 Cr.P.C.
2. Petitioner is accused in Crime No.297 of 2015 of Vidyanagar Police station registered for the offences under Sec.354 of the Indian Penal Code and Sec.9(m)(p) read with Sec.10 of the Protection of Children from Sexual Offences Act. The prosecution case is that he sexually abused a 9 year old girl.
3. Heard both sides.
4. Learned counsel submits that as the petitioner has been in custody since 08.07.2015, he may be granted bail.
5. The victim was only 9 years old. What he has done is narrated in the statement of the witnesses. He is a 38 year old man. If the petitioner is released on bail merely because he has been in custody for one month, there is every likelihood of his intimidating or influencing the witnesses. It is not at all in public interest to release the petitioner on bail at this stage.
