Petition filed under Section 438 Cr.P.C.

Petitioner along with the co-accused is alleged to have committed the offences under Sections 307, 324 and 341 of the Indian Penal Code, 1860. The prosecution case is that the petitioner restrained the victim and the other accused stabbed him with a knife, causing him serious injuries. 3.

Heard.

The very fact that the petitioner restrained the victim to facilitate stabbing by the co-accused shows that he shared the common intention with the co-accused. This is not a fit case to grant anticipatory bail.
