Petition filed under Section 438 Cr.P.C.

Petitioner is accused in Crime No.404 of 2015 of Sulthan Bathery Police Station, Wayanad District. He is accused of having committed the offence under Section 409 of the Indian Penal Code.

He was working as a U.D.Clerk in a Sulthan Bathery Grama Panchayath Office. A surprise inspection proved that he misappropriated Rs.3960/- (Rupees Three thousand nine hundred and sixty only) and thus committed the offence under Section 409 of the Indian Penal Code. 4.

Heard.

The learned counsel submits that the allegations are false and in addition to that the petitioner has deposited the amount alleged to have been misappropriated by him. Prima facie there is a case against him. Deposit of the amount will not absolve him of the liability. This is not a fit case to grant anticipatory bail.
