O R D E R

Petition filed under Section 438 Cr.P.C.

2. Petitioner is accused in Crime No.674 of 2015 of Ranny Police station registered for the offences under Sec.420 of the Indian Penal Code and Sec.17 of the Kerala Money Lenders Act. The prosecution case is that the petitioner was doing money lending business without any license and cheated the public including the victim.

3. Heard both sides.

4. According to the prosecution, the victim borrowed from him certain amount and gave a sale deed of his property as a security. The document was executed in favour of the 2nd accused. The prosecution has collected evidence to prove that the victim has paid Rs.77.5 lakhs to the close relatives of the petitioner.

5. Prima facie, the petitioner was doing money lending business without a license. It also appears that the sale deed was executed as a security. This is not a fit

B.A. No.4480 of 2015 2 case to grant anticipatory bail to the petitioner. In the result, the bail application is dismissed. Learned counsel submits that the petitioner will surrender before the investigating officer. He may do so if he is so advised.
