Petition filed under Section 439 Cr.P.C.

2. Petitioner is accused in Crime No.67 of 2015 of Kasaragod Excise Range registered for the offence under Sec.55(a) of the Kerala Abkari Act. The prosecution case is that he was found transporting 34 bottles of Indian Made Foreign Liquor contained 180 m.l. each. The liquor was supposed to be sold only in Goa.

3. Heard both sides.

4. Learned counsel submits that the petitioner has been in custody since 07.07.2015 he may be released on bail.

5. Learned Public Prosecutor submits that he is involved in other cases also. The quantity seized from him is huge. It is a clear case of illegal import.

6. The petitioner is not entitled to bail as the investigation is only in progress.
