Petition filed under Section 438 Cr.P.C.

Petitioner is the accused in Crime No.1145 of 2015 of Thodupuzha Police Station, Idukki District. He is accused of having committed the offences under Sections 377 read with Section 34 of the Indian penal Code and Section 3, 4 and 9 (J) of Protection of Children from Sexual Offences Act.

The prosecution case is that he sexually abused a boy aged 13 years.

The allegation is that the petitioner had carnal intercourse with a boy aged 13 years against the order of the nature. The statement given under Section 164 Cr.P.C by the victim narrates the incident in which the petitioner is involved. The learned counsel submits that the petitioner is a B.Tech student and if he is arrested his future will be spoiled. That is no ground to grant him

B.A. No.4605 of 2015 anticipatory bail. Having regard to the serious nature of the offence committed by him this application is only to be dismissed.
