Petition filed under Section 439 Cr.P.C.

Petitioner is the accused in Crime No.98 of 2014 of Alappuzha Excise Range. She is said to have committed the offences under Sections 8(1) and (2) and 55(g) of Kerala Abkari Act.

The prosecution case is that she was found to be in possession of 20 liters of arrack and equipments used for manufacturing arrack.

The petitioner has been in custody since 14.06.2015. She is entitled to be released on bail. In the result, this application is allowed.

The petitioner will be released on bail on her executing a bond for Rs.1,00,000/- (Rupees One lakh thousand only) with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate concerned.

She shall appear before the investigating officer till 02.09.2015 between 3.p.m. and 5.p.m and thereafter every Wednesday for four months or till the final report is filed, whichever is earlier.

She shall not threaten or attempt to influence the witnesses, nor shall she while on bail, get herself involved in any criminal case; nor shall she destroy or attempt to destroy the evidence or interfere with the investigation. 4.
She shall surrender her passport before the lower court concerned of if she does not have one, she shall file an affidavit to that effect within five days of her release. 5.
She shall not leave India without the previous permission of the court of enquiry or trial court as the case may be.
6.
She shall not enter local limits of Alappuzha Excise Range Office till 02.09.2015 except for complying with the direction in this order.
