Petition filed under Section 439 Cr.P.C.
2. Petitioner is the 4th accused in Crime No.1906 of 2015 of Kayamkulam Police station registered for the offences under Secs.115, 120B, 143, 147, 148, 307, 324, 326 and 341 read with Sec.149 of the Indian Penal Code and Sec.5(a) read with Sec.27(1) of the Arms Act. The prosecution case is that on account of previous enmity, the petitioner along with the co-accused assaulted the victim with swords pursuant to a conspiracy and the victim sustained very serious injuries.
3. Heard both sides.
4. The cause of enmity is that the victim had informed the Police about the involvement of certain accused in the offences relating to ganja. The attack was at 9.50 p.m. The weapons used were swords. The victim sustained 18 incised wounds. Merely because the petitioner has been in custody since 04.07.2015, he
B.A. No.4621 of 2015 2 cannot be released on bail as there is every likelihood of his intimidating or influencing the witnesses. So I am not inclined to grant his prayer.
