Petition filed under Section 438 Cr.P.C.

2. Petitioner is accused in Crime No.939 of 2014 of Thrikkunnapuzha Police station registered for the offences under Secs.465, 468, 469 and 471 of the Indian Penal Code. He was the Secretary of Kumaranasan Smaraka Society which is said to be a charitable society. The allegation is that he made false accounts and false entries in the registers of the society.

4. The earlier application, B.A. No.750 of 2015 filed by the petitioner was dismissed on 21.07.2015. It is submitted that the petitioner is a heart patient and has undergone bypass surgery. No subsequent development has been pleaded. Medical ground alone cannot be a ground to grant anticipatory bail having regard to the nature of the offences.

B.A. No.4630 of 2015 2 In the result, the bail application is dismissed. If the petitioner happens to be arrested, the investigating officer may take notice of the fact that he is a heart patient.
