O R D E R

Petition filed under Section 439 Cr.P.C.

2. Petitioner is accused in Crime No.94 of 2015 of Karunagappally Excise Range registered for the offence under Sec.55(i) of the Kerala Abkari Act. The prosecution case is that the petitioner was found to be in possession of 700 m.l. of Indian Made Foreign Liquor which according to the prosecution she had kept for sale.

3. Heard both sides.

4. Learned counsel submits that the petitioner is aged 70 years and the quantity of liquor seized from her is only 700 m.l.

5. The petitioner is involved in five other cases registered under the Kerala Abkari Act. Merely because she has been in custody since 24.06.2015, she cannot be granted bail as I am not satisfied that she will not commit the offence again if she is released on bail.
