Petition filed under Section 439 Cr.P.C.

2. Petitioner is accused in Crime No.82 of 2015 of Karunagappally Excise Range registered for the offence under Sec.55(i) of the Kerala Abkari Act. The prosecution case is that the petitioner was found selling Indian Made Foreign Liquor near a tea shop.

3. Heard both sides.

4. Learned counsel submits that the petitioner is a woman aged about 70 years, she has been in custody since 14.07.2015 and she may be granted bail.

5. The petitioner is involved in five other cases registered under the Kerala Abkari Act. I am not satisfied that if the petitioner is released on bail she will not commit the offence again.

In the result, the bail application is dismissed. Sd/- K. ABRAHAM MATHEW JUDGE / True Copy / NS P.A. To Judge
