Petition filed under Section 438 Cr.P.C.

Petitioner is the 6th accused in Crime No. 21 of 2015 of Excise Range office, Aluva. He is said to have committed the offences under Sections 21C and 29 of the NDPS Act. 3.

The Excise Officers attached to Aluva Excise Range office seized 1.650 km of heroine from a godown. It is alleged that the petitioner was involved in the commission of the offence. 4.

Heard.

The prosecution case is that the heroine was brought from Jammu & Kashmir by accused 1 to 3 who were only carriers. The 4th accused also was arrested. The confession statements of accused 1 to 4 reveal that the petitioner is the prime accused and is responsible for possession of the contraband. It is not proper to grant him anticipatory bail.
