Petition filed under Section 439 Cr.P.C.

Petitioner is the second accused in Crime No.58 of 2000 of Thalapuzha Police Station. He is said to have committed the offence under Section 55(a) of the Abkari Act. 3.
The prosecution case is that he was found to be in possession of 1.875 liters of IMFL.

Heard both sides.

The learned counsel submits that the petitioner has been in custody since 13.07.2015 and he may be granted bail. The incident happened in 2000. The petitioner was absconding. So his case was transferred to register of long pending cases and the trial of the co-accused was proceeded with. He was arrested only on 13.07.2015. He was absconding for about 15 years. There is no question of granting bail to him.
