Petitioner is the accused in Crime No.408 of 2015 of Manjeshwar Police Station, Kasaragod District. He is said to have committed the offence under Section 55(a) of the Abkari Act.

The prosecution case is that he was found transporting 24 packets of Indian Made Foreign Liquor each containing 180ml which was meant for sale only in Karnataka.

The learned counsel submits that the petitioner has been in custody since 27.07.2015. The purpose for which he was transporting the liquor is clear from the quantity that was seized. This is not a fit case to grant bail at this stage. I am not satisfied that if he is released on bail he will not commit the offence again especially in
B.A. No.4816 of 2015 vies of the Onam.
