Petition filed under Section 438 Cr.P.C.
2. Petitioner is the 1st accused in Crime No.768 of 2015 of Chathannur Police Station registered for the offences punishable under Secs.323, 324 and 326 read with Sec.34 of the Indian Penal Code. The prosecution case is that on 26.04.2015 at about 10.00 p.m., the petitioner with a view to wreak vengeance against the defacto complainant for demanding excessive auto fair, attacked him with an iron rod causing him grievous injuries.
4. Heard both sides.
5. Learned counsel for the petitioner submitted that the petitioner was undergoing treatment for dislocation and he went for treatment even on 22.04.2015.
6. Learned Public Prosecutor opposed the bail application contending that the petitioner is involved in
Bail Appl. No.4829 of 2015 2 various crimes including the one under Sec.302 of the Indian Penal Code. It is also submitted that the petitioner figures in the rowdy list and was once detained under the KAAPA.
Considering the nature of allegations and the antecedents of the petitioner, I am not inclined to grant him anticipatory bail.
