O R D E R
Petition filed under Section 438 Cr.P.C.
2. Petitioner is the 4th accused in Crime No.34 of 2015 of Kaliyar Police station registered for the offences under Secs.323, 341 and 384 read with Sec.34 of the Indian Penal Code. The allegation is that while the first informant was riding a motor bike, the petitioner along with the co-accused blocked the vehicle and robbed him of Rs.2,430/- (Rupees two thousand four hundred and thirty only).
3. Heard both sides.
4. The co-accused have been granted bail by this court. So I am inclined to grant the prayer of the petitioner also.
In the result, the bail application is allowed.
1) The petitioner shall be released on bail after interrogation on his executing a bond for
B.A. No.4871 of 2015 2 Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties each for the like sum if he is arrested by the Police in connection with this case.
2) He shall appear before the Investigating Officer between 10.00 a.m. and 11.00 a.m. every Friday for three months or till the final report is filed, whichever is earlier.
3) He shall surrender his passport before the lower court concerned or if he does not have one, file an affidavit to that effect within five days of his release.
4) He shall not get himself involved in any other criminal case while he is on bail.
5) He shall not destroy or tamper with evidence.
6) He shall not intimidate or attempt to influence the witnesses
7) He shall deposit in the trial court
B.A. No.4871 of 2015 3 Rs.2,430/- (Rupees two thousand four hundred and thirty only) within five days from today.
8) It shall be held by the court subject to the result of the proceedings.
In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with the law.
If the petitioner surrenders before the Magistrate, this order is not applicable and the learned Magistrate may pass appropriate orders.
