Petition filed under Sec.438 Cr.P.C.
2. Petitioner is the accused in Crime No.885 of 2014 of Cherthala Police station registered for the offences punishable under Secs.409 and 201 of the Indian Penal Code, Sec.65 of the Information Technology Act and Sec.3(1) of the Prevention of Destruction of Public Properties Act.
3. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
4. Learned counsel for the petitioner submitted that the petitioner, while working as a Junior Assistant in Taluk Supply office, Cherthala, raised complaints against his higher ups pointing out the irregularities regarding the functioning of a Maveli store. It is also submitted that manipulations in the computer in the store was also brought to the notice.
5. Per contra, learned Public Prosecutor contended that the petitioner is a computer techie and he
Bail Appl. No.4842 of 2014 2 removed the hard disc from the computer and put another one in its place by tampering the data therein. That apart, he committed falsification of accounts causing a total loss of Rs.39 lakhs.
Considering the entire facts and circumstances, following directions are issued.
i. The petitioner shall surrender before the investigating officer within a period of one week and submit himself for interrogation.
ii. In the event of arrest, the petitioner shall be released on his executing a bond for Rs.50,000/- (Rupees fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the investigating officer.
3. The petitioner shall co-operate with investigation of the case.
