Petition filed under Section 439 Cr.P.C 2.
Petitioner is the first accused in Crime No.1637 of 2015 of Kalady Police Station. He is said to have committed the offences under Sections 341, 326 of the Indian penal Code.

The prosecution case is that he along with the co-accused wrongfully restrained the victim and assaulted him with dangerous weapons causing fracture on his bone. 4.
Heard.

The learned counsel submits that the petitioner has been in custody since 22.07.2015 and he may be granted bail. On the other hand, the learned Public Prosecutor has brought to my notice that he is involved in three other similar cases and he attempted to escape from custody in this case. The facts of the case do not justify granting him bail at this stage.
