O R D E R

Petition filed under Section 439 Cr.P.C.

2. Petitioner is accused in Crime No.1263 of 2015 of Nemom Police station registered for the offences under Secs.8, 11(iv) and 12 of the Protection of Children from Sexual Offences Act. The prosecution case is that he sexually abused a boy aged 17 years who happened to travel along with him in a bus.

3. Heard both sides.

4. Learned counsel submits that the allegations are false and the petitioner has been in custody since 20.07.2015. He is working as a U.D. Clerk in the Harijan Welfare Department under the Government of Kerala.

5. I have perused the statement of the victim. He is aged about 17 years and a plus two student. It is seen from the First Information Statement that the petitioner used to abuse him from his 10th standard. The

B.A. No.4965 of 2015 2 incident took place during their journey in a bus. It appears that he purposefully entered the bus in which the victim was travelling. The investigation is in progress. Releasing the petitioner on bail at this stage will hamper the investigation. So I am not inclined to grant his prayer. In the result, the bail application is dismissed. Sd/- K.
