Petition filed under Section 438 Cr.P.C.
2. Petitioner is accused in Crime No.504 of 2015 of Kasaragod Police station registered for the offences under Secs.468 and 471 of the Indian Penal Code and Sec.12(1)(b) of the Passport Act. The prosecution case is that on the strength of forged school certificate and caste certificate, the petitioner applied for passport.
3. Heard both sides.
4. Learned counsel submits that the petitioner did not apply for passport and some one else must have made the application because of the enmity towards him.
5. Prima facie this is not acceptable because the photographs of the petitioner is seen in the application form. The documents are available in the Case Diary. It appears that detailed investigation is necessary into the incident. Granting anticipatory bail will hamper
B.A. No.4983 of 2015 the investigation.
In the result, the bail application is dismissed. Learned Public Prosecutor submits that the petitioner will surrender before the investigating officer. He may do so if he is so advised.
