Petition filed under Section 439 Cr.P.C.

Petitioner is the accused in Crime No. 67 of 2015 of Kasaragod Excise Range. He is said to have committed the offence under Section 55(a) of the Kerala Abkari Act. 3.

He was found transporting 34 bottles each having the capacity of 180 ml of Indian Made Foreign Liquor, which was meant to be sold in Goa only.

Learned counsel submits that as the petitioner has been in custody since 07.07.2015, he may be granted bail. The quantity of liquor seized from him is huge. The purpose is very clear. It was brought from Goa. I am not satisfied that if he is released on bail now, he will not commit the offence again. So, I am not inclined to grant his prayer.
