ORDER
This petition is filed under Section 438 of Cr.P.C for anticipatory bail.
2. Heard the learned counsel appearing for the petitioners and the learned Public Prosecutor appearing for the respondent.
3. Learned counsel for the petitioners submits that the petitioners apprehend arrest by Erumeli police in Crime No.652 of 2015 on an accusation of having committed a non-bailable offence. The police came to the houses of the petitioners and threatened that they would be arrested. In such circumstances, the petitioners were compelled to approach this Court by filing this Bail Application under Section 438 of Cr.P.C.
4. Learned Public Prosecutor, on instructions, submits that the petitioners are not accused in Crime No.652 of 2015
B. A. No.5024 of 2015 -2of Erumeli Police Station. Therefore, the apprehension of the petitioners that they would be arrested by Erumeli police has no basis. In view of the submissions so made by the learned Public Prosecutor, this Bail Application does not survive.
