Application filed under Section 438 of the Code of Criminal Procedure.

Petitioners are accused Nos. 1 to 3 in Crime No.1386 of 2015 of Sasthamcotta Police Station. They apprehend arrest in the above crime at the hands of Police.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

Learned Public Prosecutor submitted that apart from Sections 294(b), 341, 323 and 324 of the Indian Penal Code shown in the bail application, the petitioners are involved in an offence under Section 326 of the Indian Penal Code also. The alleged incident was on 04.08.2015 at about 06.00 p.m., wherein the first accused inflicted an injury on the de facto complainant with the key of a Motor bike and the third accused used an iron rod to assault the de facto complainant.
B.A.No.5058 of 2015 Considering the nature of the allegations, I am of the view that the petitioners are not entitled to get anticipatory bail. They can surrender before the concerned court and move for regular bail.
Bail application is dismissed.
